The CAN-SPAM Act of 2003 was passed by Congress as a direct response to the growing number of complaints over spam e-mails. Congress determined that the US government was showing an increased interest in the regulation of commercial electronic mail nationally, that those who send commercial e-mails should not mislead recipients over the source or content of them, and that all recipients of such emails have a right to decline them. The act authorizes a US $16,000 penalty per violation for spamming each individual recipient. However, it does not ban spam emailing outright, but imposes laws on using deceptive marketing methods through headings which are "materially false or misleading". In addition there are conditions which email marketers must meet in terms of their format, their content and labeling. As a result, many commercial email marketers within the United States utilize a service or special software to ensure compliance with the act. A variety of older systems exist that do not ensure compliance with the act. To comply with the act's regulation of commercial email, services also typically require users to authenticate their return address and include a valid physical address, provide a one-click unsubscribe feature, and prohibit importing lists of purchased addresses that may not have given valid permission.
Beyond incentives, often a key part of the conversion funnel that can be optimized is the lead form. Although it is beneficial from a business standpoint to collect as much information as possible about a prospect, more forms fields leads to a reduction in form submissions. Experiment with different form lengths to see what is optimal in terms of lead capture and lead information.

What should be the time frame between sends? At the beginning, you want to ensure that you do not take too long between sends. Your subscribers have just signed up and are enthusiastic about receiving your communication, so take advantage of that enthusiasm.While once daily is too frequent, you can begin by spacing your emails out with only a day in between. After that, extend the time between to three days. As you get to the tail end of your auto responder, meaning that you are getting to the least engaged customers who have not converted and may mark you as spam or opt-out of the email, begin to stretch things out by five days or even a week. Many email marketing service providers will allow you to also mark days of the week that you don't want your auto responder to send, so you may want to eliminate weekend email sends of auto responders. Email open rates are lower on weekends.

Don't use CTAs to drive people to your homepage, for instance. Even if your CTA is about your brand or product (and perhaps not an offer like a download), you should still be sending them to a targeted landing page that's relevant to what they are looking for and includes an opt-in form. If you have the opportunity to use a CTA, send them to a page that will convert them into a lead.

Great advice on B2B marketing in these four primary channels. I’ve also seen that the most successful B2B channels can vary greatly by niche and vertical. In my industry, paid and organic search are king, with email, content and social supplementing our search marketing. Purchased lists are ineffective, and they impact everyone else who uses Mailchimp, too. If you send emails to a list of people whose contact info you bought, many of the emails will get identified as spam. Some spam filters will flag a campaign if anyone with the same IP has sent spam in the past. When you use Mailchimp, your email is delivered through our servers, so if one person sends spam, it could prevent other users’ emails from reaching inboxes.
